Even when litigation is well managed, the parties to it must typically endure a lengthy and expensive distraction.  Therefore, as a general rule, one should try hard to avoid and minimize litigation.  But sometimes litigation arrives uninvited; and sometimes one should spearhead litigation in order to secure a fair outcome.

Henderson has more than a decade of cumulative litigation experience, including successfully prosecuting civil trials for plaintiffs in federal and state courts, obtaining writs of mandate and successfully prosecuting complaints against governmental entities, and arguing before both state and federal appellate courts as well as the Supreme Court of the United States.  When necessary, Henderson will not shrink from engaging his clients' adversaries. Whenever doing so, Henderson's aim is to help clients get through the process and back to their chosen work – always as soon, whole, and successful as possible.

Henderson also takes advantage of alternative dispute resolution (ADR) processes, and encourages prompt mediation whenever the parties will benefit from avoiding litigation.  Too often, creative solutions are overlooked or dismissed by dug-in adversaries, and thus forgone.  Henderson works with his clients to shape creative solutions whenever possible.
