The Henderson Law Firm counsels and represents clients concerning environmental law compliance and regulatory disputes, mostly related to real estate development. Henderson has successfully represented former clients in complex proceedings and actions under federal and state environmental laws, such as the federal Clean Water Act. For example, Henderson successfully petitioned California's State Water Resources Control Board and secured a remand and correction of the Los Angeles Regional Water Quality Control Board's county-wide storm water (MS4) permit for Ventura County. His experience enables him to counsel land owners, developers, builders and others in the regulated community concerning compliance with the National Pollution Discharge Elimination System (NPDES), dredge and fill and stream bed alteration permits and agreements, and other aspects of the federal and state interfaces. Henderson helps clients to marshal evidence and legal points when a regulatory enforcement action arises.
Henderson similarly works within the federal Endangered Species Act (and its California equivalent), as well as with increasingly-restrictive federal and state wetlands, coastal, riverine, and riparian regulations. He remains at the forefront of policy discussions concerning regional planning, sustainable development, and growing regulatory imperatives aimed at linking land use approvals to vehicular air pollution, vehicle miles traveled and climate change concerns. When necessary to facilitate the reuse of previously-developed land, Henderson can assist clients with addressing and resolving basic "brownfield" issues (i.e., environmental remediation and assigning responsibility for its costs).
